Please read these Terms carefully before using the Service. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.
By creating an account, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
You must be at least 13 years of age to use the Service. If you are between 13 and 18 years of age (or the age of majority in your jurisdiction), you must have your parent or legal guardian's permission to use the Service.

You are solely responsible for all activities that occur under your account. We are not liable for any loss or damage arising from your failure to protect your account credentials.
Each user may maintain only one account. Creating multiple accounts may result in termination of all accounts.
The Service offers various subscription tiers with different features and limitations. Current offerings include free and paid tiers, the details of which are available within the app or on our website.
Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You will be charged the then-current subscription rate upon renewal.
We reserve the right to change subscription prices. Any price changes will be communicated in advance and will apply to the next billing cycle following notice.
Free tier users have access to limited features, including restricted meal history (7 days) and basic functionality. We reserve the right to modify free tier limitations at any time.
If you use the TalkToTrack API, the following additional terms apply:
API usage is subject to rate limits and daily quotas based on your subscription tier:

You retain ownership of the content you submit through the Service (meal descriptions, profile information, etc.). By using the Service, you grant us a limited license to process this content solely to provide and improve the Service.

The Service, including its design, features, functionality, and content (excluding User Content), is owned by Genesant Technologies Inc and protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our written permission.
"TalkToTrack," "Genesant Technologies," and associated logos are trademarks of Genesant Technologies Inc. You may not use these trademarks without our prior written consent.

TALKTOTRACK IS NOT A MEDICAL DEVICE AND IS NOT INTENDED TO DIAGNOSE, TREAT, CURE, OR PREVENT ANY DISEASE OR HEALTH CONDITION.
The nutrition information and tracking features are for informational and educational purposes only. They are not substitutes for professional medical advice, diagnosis, or treatment. Always consult a qualified healthcare provider before making dietary changes, especially if you have health conditions, allergies, or are pregnant or nursing.
While we strive to provide accurate nutrition information using authoritative sources (USDA, Open Food Facts) and AI-assisted analysis, nutrition values are estimates and may vary based on:

We do not guarantee that the Service will be available at all times or without interruption. The Service may be subject to limitations, delays, and other problems inherent in the use of the internet and electronic communications.
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
IN NO EVENT SHALL GENESANT TECHNOLOGIES INC, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR LIMITATION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
You agree to defend, indemnify, and hold harmless Genesant Technologies Inc and its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:
These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, United States, without regard to its conflict of law provisions.
Before filing any formal legal action, you agree to first contact us at support@talktotrack.com to attempt to resolve the dispute informally. We will attempt to resolve the dispute within 30 days.
If we cannot resolve a dispute informally, any dispute arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules. The arbitration shall be conducted in Fairfax County, Virginia, unless you and we agree otherwise.
YOU AND GENESANT TECHNOLOGIES INC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights.
You may terminate your account at any time through the "Delete Account" page in the app settings. This will permanently delete your account and all associated data.
We may suspend or terminate your account and access to the Service at any time, with or without cause, and with or without notice, including if we believe you have violated these Terms.
Upon termination:
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by:
Your continued use of the Service after the effective date of any changes constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Service.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Genesant Technologies Inc regarding the Service.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
These Terms do not create any third-party beneficiary rights.
